1. About PrivéStay

PrivéStay provides a digital ordering and request platform accessible via QR code or link, allowing guests to order food, services, or submit requests during their stay — without downloading an app or creating an account.

PrivéStay acts as a technology provider only and does not own, operate, or manage any hospitality property.

2. Guest Use of the Platform

Guests may use PrivéStay to place orders or submit service requests during an active stay.

By using the platform, guests agree to:

  • Provide accurate information when submitting requests
  • Use the service in a lawful and respectful manner
  • Understand that fulfillment is managed by the property, not PrivéStay

PrivéStay does not require guest registration, accounts, or logins.

3. Time-Bound Access

Guest access to PrivéStay is:

  • Limited to the duration of the stay
  • Automatically expired at checkout
  • Subject to termination or renewal by the hospitality provider at any time

Access does not persist beyond the stay period.

4. Orders, Requests & Fulfillment

All orders and service requests submitted through PrivéStay are processed using the hospitality provider's proprietary order management and service workflows.

PrivéStay acts solely as a secure digital interface that enables guests to submit orders and requests during their stay. The platform integrates into the property's internal operational systems and does not rely on consumer messaging platforms or third-party chat applications for order fulfillment.

The hospitality provider is solely responsible for:

  • Service availability and pricing
  • Order preparation and delivery
  • Response times and service quality
  • Property-specific policies and execution

PrivéStay does not guarantee fulfillment outcomes and is not responsible for delays, service limitations, or operational decisions made by the property.

Any questions, issues, or concerns related to orders or services should be addressed directly with the hospitality provider.

5. Payments

PrivéStay does not process guest payments unless explicitly enabled by the hospitality provider.

Where payments are enabled, they are processed according to the provider's terms and applicable payment policies.

6. Availability of the Service

PrivéStay strives to provide reliable service but does not guarantee uninterrupted availability.

Temporary interruptions may occur due to maintenance, updates, or factors outside our control.

7. Intellectual Property

All rights, titles, and interests in the PrivéStay platform, including software, design, and branding, remain the exclusive property of PrivéStay.

Guests and partners may not copy, modify, or misuse any part of the platform.

8. Limitation of Liability

To the maximum extent permitted by law, PrivéStay shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of revenue, profit, or business opportunities
  • Guest dissatisfaction related to service fulfillment

PrivéStay's role is limited to providing the platform.

9. Termination

Hospitality partners may suspend or terminate access to PrivéStay at any time in accordance with their service agreement.

PrivéStay may suspend access if the platform is misused or if these Terms are violated.

10. Privacy & Data Protection

PrivéStay processes minimal data in accordance with its Privacy Policy.

Guests are not required to provide personal data beyond an optional first name for service identification.

11. Changes to These Terms

PrivéStay may update these Terms from time to time. Updates will be reflected by the "Last updated" date.

Continued use of the platform constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the applicable jurisdiction in which the hospitality service is provided, without regard to conflict of law principles.
